1. WHAT INFORMATION DO WE COLLECT?
Personal information you disclose to us
In Short: We collect personal information that you provide to us.
We collect personal information that you voluntarily provide to us when you register for the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities within the Services, or otherwise when you contact us. The personal information we collect may include the following: Names; Phone numbers; Email addresses; Usernames; Passwords; Contact or authentication data; Contact preferences.
Creator Content. When you use the Services as a creator, we process the content you create, upload or send through the Services, including text messages, photographs, videos, voice notes and similar media (“Creator Content”), together with related metadata (such as timestamps and the recipients you send it to). This content is stored on secured infrastructure operated by us or by our hosting and messaging service providers acting on our behalf. Access is limited to authorized personnel and service providers on a need-to-know basis for operating the Services, providing support, ensuring safety and complying with law.
Sensitive Information.
Some Creator Content may, depending on its nature, constitute sensitive personal information under applicable law. We process such content only as necessary to provide the Services and, where required by applicable data protection law (such as Article 9 GDPR), on the basis of your explicit consent, and we apply appropriate safeguards to protect it.
Payment Data.
We may collect data necessary to process your payment if you make purchases, such as your payment instrument number and the security code associated with your payment instrument. All payment data is processed and stored by Stripe and Visa. All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.
Information automatically collected
In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.
We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, and information about how and when you use our Services. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes. We also collect information through cookies and similar technologies. The information we collect includes Log and Usage Data, Device Data, and Location Data.

In Short: We process your information to provide, improve, and administer our Services, to communicate with you, for security and fraud prevention, and to comply with the law.
We process your personal information for various reasons, including: to facilitate account creation and authentication and otherwise manage user accounts; to deliver and facilitate delivery of services to the user; to send administrative information to you; to enable user-to-user communications; to request feedback; to send you marketing and promotional communications (in accordance with your marketing preferences); to protect our Services, including monitoring our systems for fraud prevention; and to save or protect an individual’s vital interests.
3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR DATA?
In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason to do so under applicable law.
If you are located in the EU or UK, the General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on. We may rely on the following: Consent (which you can withdraw at any time by emailing support@fanblast.com); Performance of a Contract; Legitimate Interests; Legal Obligations; and Vital Interests.
If you are located in Canada, we may process your information if you have given us express or implied consent, which you can withdraw at any time. In certain exceptional cases we may be legally permitted to process your information without your consent, as permitted by applicable law.
4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL DATA?
In Short: We may share information in specific situations described in this section and/or with the following third parties.
We may need to share your personal information in the following situations: Business Transfers (in connection with any merger, sale of company assets, financing, or acquisition); Affiliates (who we will require to honor this privacy notice); and Business Partners (to offer you certain products, services, or promotions).
5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?
In Short: We may use cookies and other tracking technologies to collect and store your information.
We may use cookies and similar tracking technologies (like web beacons and pixels) to collect information when you interact with our Services. Some help us maintain security, prevent crashes, fix bugs, save your preferences, and support basic site functions. We also permit third-party vendors and service providers to use online tracking technologies for analytics and advertising purposes. To the extent these are deemed a “sale” or “sharing” under applicable US state laws, you may opt out. We may share information with Google Analytics to track and analyze the use of the Services. 6. HOW LONG DO WE KEEP YOUR INFORMATION?
In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law.
We keep your personal information only for as long as your account is active and for a limited period afterwards. On closure of your account, we delete or anonymize your account information and your Creator Content (photos, videos, voice notes and messages) from active systems within thirty (30) days. Residual copies in routine back-ups are deleted within the standard back-up cycle. We may retain limited information for longer only where required by law (for example, tax or accounting obligations) or to establish, exercise or defend legal claims, in which case we isolate it from any further processing until deletion is possible.
7. HOW DO WE KEEP YOUR INFORMATION SAFE?
In Short: We aim to protect your personal information through a system of organizational and technical security measures.
We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. You should only access the Services within a secure environment.
8. DO WE COLLECT INFORMATION FROM MINORS?
In Short: We do not knowingly collect data from or market to minors.
By using the Services, you represent that you are at least 18 years of age.
9. WHAT ARE YOUR PRIVACY RIGHTS?
In Short: Depending on your state of residence in the US or in certain regions, such as the EEA, the UK, Switzerland, and Canada, you have rights that allow you greater access to and control over your personal information.
In some regions you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information; (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; (iv) if applicable, to data portability; and (v) the right not to be subject to automated decision-making. In certain circumstances, you may also have the right to object to the processing of your personal information. If you are located in the EEA or UK and you believe we are unlawfully processing your personal information, you also have the right to complain to your Member State data protection authority or the UK data protection authority.
Withdrawing your consent: You have the right to withdraw your consent at any time. Opting out of marketing and promotional communications: You can unsubscribe at any time by clicking the unsubscribe link in our emails, replying “STOP” to SMS messages, or contacting us. Account Information: If you would at any time like to review or change the information in your account or terminate your account, you can log in to your account settings; upon your request to terminate your account, we will deactivate or delete your account and information from our active databases.
10. CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. California law requires us to let you know how we respond to DNT signals; because there is currently no industry or legal standard, we do not respond to them at this time.
11. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?
In Short: If you are a resident of certain US states, you may have the right to request access to and receive details about the personal information we maintain about you and how we process it, correct inaccuracies, get a copy of, or delete your personal information.

Some Creator Content processed through the Services may constitute sensitive personal information under applicable law, which is why Category L is marked YES. Category E (biometric information) is marked NO because the Services do not perform biometric processing such as voiceprint analysis.
We may disclose your personal information with our service providers pursuant to a written contract between us and each service provider. We may use your personal information for our own business purposes, such as for internal research for technological development and demonstration; this is not considered a “sale” of your personal information.
We do not sell your personal information for money. We share personal information with service providers (such as hosting, messaging and payment providers) only as needed to operate the Services and under written contract. Some of our use of analytics and advertising technologies (for example, Google Analytics Advertising Features) may be considered a “sale” or “sharing” under certain US state privacy laws; where that is the case, you can opt out as described in this section and in our Cookie Notice.
Your Rights: You have rights under certain US state data protection laws, including the right to know whether we are processing your personal data, to access it, to correct inaccuracies, to request deletion, to obtain a copy, to non-discrimination for exercising your rights, and to opt out of processing for targeted advertising, sale, or profiling. To exercise these rights, contact us by submitting a data subject access request via email at support@fanblast.com. Under certain US state privacy laws you may designate an authorized agent and, if we decline a request, you may appeal by emailing support@fanblast.com.
12. DO WE MAKE UPDATES TO THIS NOTICE?
